These Terms and Conditions govern the use of services provided by Old Express ("the Company"). By using our services, you ("the Customer") agree to be bound by these terms. Please read them carefully before placing any shipment.
1. Definitions
"Shipment" refers to any package, document, parcel, or cargo entrusted to Old Express for delivery. "Sender" refers to the person or entity requesting the shipping service. "Receiver" refers to the intended recipient of the shipment.
2. Acceptance of Shipments
Old Express reserves the right to refuse any shipment at its sole discretion. We may inspect any shipment to verify its contents, weight, and compliance with applicable laws and regulations. All shipments are accepted subject to these Terms and Conditions.
- Shipments must comply with all applicable local and international laws.
- The sender is responsible for providing accurate and complete shipping information.
- Old Express reserves the right to open and inspect packages for security purposes.
3. Prohibited Items
The following items are strictly prohibited from shipment through Old Express:
- Hazardous materials, explosives, and flammable substances
- Firearms, weapons, and ammunition
- Narcotics, illegal drugs, and controlled substances
- Counterfeit goods and pirated materials
- Live animals and perishable biological substances
- Currency, precious stones, and negotiable instruments (unless pre-arranged)
- Items prohibited by international shipping regulations or destination country laws
4. Packaging & Labeling
The sender is responsible for ensuring that all shipments are properly packaged and labeled. Old Express shall not be held liable for damage resulting from inadequate packaging. We recommend using sturdy containers and appropriate cushioning materials for all shipments.
5. Rates & Payment
Shipping rates are based on the actual weight or volumetric weight (whichever is greater), destination, and service type. All charges must be paid in full before the shipment is dispatched unless a credit arrangement has been established. Rates are subject to change without prior notice.
- Volumetric weight is calculated as: Length × Width × Height (cm) / 5000
- Additional charges may apply for remote areas, customs duties, and special handling
- Payment methods accepted: Cash, Bank Transfer, Mobile Banking
6. Delivery & Transit Times
Estimated delivery times are provided in good faith but are not guaranteed. Transit times may vary due to customs clearance, weather conditions, regulatory requirements, public holidays, or other factors beyond our control. Old Express shall not be liable for delays caused by force majeure events.
7. Customs Clearance
International shipments are subject to customs inspection and clearance. The receiver is typically responsible for any customs duties, taxes, and import fees. Old Express will assist with customs documentation but cannot guarantee clearance timelines or duty-free entry.
8. Liability & Insurance
Old Express's liability for loss or damage is limited to the declared value of the shipment or the maximum liability as defined by applicable international conventions (Warsaw Convention, Montreal Convention), whichever is lower. We strongly recommend purchasing additional insurance coverage for valuable shipments.
- Claims must be filed within 30 days of the scheduled delivery date
- Proof of value must be provided for all claims
- Old Express is not liable for indirect, consequential, or special damages
9. Claims Procedure
To file a claim for loss, damage, or delay, the customer must submit a written claim to Old Express within 30 days of the scheduled delivery date. Claims must include the tracking number, description of the issue, photographs of damage (if applicable), and proof of the shipment's value.
10. Privacy & Data Protection
Old Express collects and processes personal data solely for the purpose of providing shipping services. We are committed to protecting your privacy and will not share your personal information with third parties except as required for shipment delivery or as mandated by law.
11. Indemnification
The sender agrees to indemnify and hold harmless Old Express from any claims, damages, fines, or penalties arising from the shipment of prohibited items, inaccurate declarations, or non-compliance with applicable laws and regulations.
12. Amendments
Old Express reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting on our website. Continued use of our services after such modifications constitutes acceptance of the updated terms.
13. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising from the use of our services shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
